Izvēle, kas nekaitē citiem 168
Latvijā pastāvošās embriju aizsardzības normas un abortu veikšanas ierobežojumi atbilst mūsdienu bioētikas nozīmīgākajiem principiem. Lai mazinātu abortu skaitu, nav pamata mainīt likumā iekļautās normas. Svarīgi ir lielāku uzmanību pievērst izglītībai un sociālā atbalsta pasākumiem.
Diskusijās par ētikas problēmām būtiska nozīme ir valodas lietojumam. Termini un to definīcijas lielā mērā nosaka diskusijas gaitu, kā arī ētiskās un tiesiskās sekas. Medicīnā uz sākotnējām cilvēka dzīvības attīstības stadijām pēc olšūnas un spermatozoīda saplūšanas ir vispārpieņemts attiecināt terminu ‘embrijs’, sākot ar devīto nedēļu pēc apaugļošanās sāk lietot terminu ‘auglis’, un tikai pēc dzimšanas tiek lietots termins ‘bērns’. Aprīlī notikušās konferences “Aborts – medicīniska manipulācija vai bērna nogalināšana” rezolūcijā piedāvāts veikt būtiskas likuma izmaiņas, kas neņem vērā šo vispārpieņemto terminu lietojumu. Priekšlikums - mainīt Bērnu tiesību likuma 7. pantu, norādot, ka bērnam ir tiesības uz dzīvību un attīstības aizsardzību no ieņemšanas brīža. Piedāvātās izmaiņas, kuru paredzamās sekas ir stingrāku abortu veikšanas nosacījumu ieviešana, ir rosinājušas asas debates sabiedrībā, tādēļ ir būtiski izvērtēt to ētisko pamatojumu.
Bioētikas principi
Bioētikas argumentācija bieži tiek balstīta uz T. Bīčema un Dž.Čildresa izveidoto četru principu pieeju[1], kas ir viena no ietekmīgākajām teorijām mūsdienu bioētikā. Šo ētikas principu mērķis bija izveidot minimālo nosacījumu kopumu, kas pamatotu rīcību un izvēles medicīnā. Pirmais no Bīčema un Čildresa minētajiem principiem ir autonomijas jeb pašnoteikšanās princips. Autonomija tiek definēta kā personiskā rīcības brīvība, kas ļauj indivīdam izvēlēties rīcību atbilstoši viņa/viņas vērtībām un interesēm. Ārsta un sabiedrības morālais pienākums ir respektēt personas autonomiju, kamēr tā nenodara kaitējumu citām personām. Šis princips ir balstīts I. Kanta filosofijā un liberālajā politiskajā filosofijā. Nekaitēšanas princips nosaka ārsta pienākumu nekaitēt pacientam/ei fiziski vai psiholoģiski, un tas ir cieši saistīts ar laba darīšanas principu, kurš nosaka pienākumu darīt labu, uzlabojot pacienta/es veselību, kā arī līdzsvarot iespējamos ieguvumus un riskus. Taisnīguma princips nosaka vienlīdzīgu pieeju veselības aprūpei, kā arī godīgu resursu sadali.
Personas autonomija kā reprodukcijas brīvība
Autonomijas princips reprodukcijas jomā parasti tiek interpretēts kā reprodukcijas brīvība[2], kas ietver gan personas tiesības radīt bērnus, izmantot medicīniskās apaugļošanas tehnoloģijas, gan arī izvairīties no grūtniecības, lietojot kontracepciju, ievērojot noteiktus ierobežojumus un veikt abortu. Morālās tiesības uz reprodukcijas brīvību ir pamatotas ar reprodukcijas būtisko nozīmi personas dzīvē un identitātes veidošanā. Reprodukcijas brīvība, galvenokārt, ir negatīvas tiesības uz valsts neiejaukšanos. Tas nozīmē, ka liberāli demokrātiskā sabiedrībā valsts pienākums ir ievērot neitralitāti attiecībā uz personu reproduktīvajām izvēlēm, kamēr šīs izvēles nekaitē citām personām. Ja personai tiek aizliegts izvēlēties radīt vai neradīt bērnus, tiek būtiski ierobežota viņa/s brīvība kontrolēt savu dzīvi. Vienlaikus tiek nodarīts arī būtisks kaitējums sabiedrībai kā veselumam, jo tiek apšaubītas liberāli demokrātiskas sabiedrības pamatvērtības. Neapšaubāmi, jebkuras autonomas izvēles veikšanai ļoti svarīga ir informācijas pieejamība, tādēļ ir ļoti svarīgi izglītot sabiedrību reproduktīvās veselības jautājumos, it īpaši skolā. Arī ārsta pienākums ir informēt sievieti par riskiem, kas saistīti ar aborta veikšanu, tomēr ir rūpīgi jāapsver šādas informācijas saturs un pasniegšanas veids, lai tā nekļūtu par psiholoģisku kaitējumu.
Ar terminu ‘persona’ plašākā nozīmē tiek apzīmētas būtnes, kam piemīt viens vai vairāki nozīmīgi raksturojumi, piemēram, sevis apzināšanās un racionalitāte. Ētikā ar terminu ‘persona’ apzīmē būtnes, kam piemīt pilns morālais statuss, kas ietver tiesības uz dzīvību, autonomu izvēli utml. Šai kontekstā būtisks ir jautājums, vai embrijs tiek uzskatīts par personu? Cilvēka embrijs un auglis viennozīmīgi nav lieta vai tikai šūnu kopums, tomēr pilnu morālo statusu un ar to saistīto aizsardzību tas iegūst pakāpeniskas attīstības gaitā, nevis uzreiz pēc apaugļošanās. Fakts, ka personas raksturojumi embrijam attīstās pakāpeniski, neļauj pielīdzināt embrija morālo statusu jau piedzimušam bērnam. Šī pieeja ir viens no pamatojumiem likumā noteiktajam ierobežojumam, kas ļauj veikt legālu abortu līdz 12. grūtniecības nedēļai.
Vienlaikus, nenoliedzami svarīgs jautājums ir ārsta tiesības uz autonomiju – tiesības atteikties no aborta veikšanas, ja šāda rīcība ir pretrunā ar ārsta morālajiem uzskatiem. Kā jau iepriekš minēts, sievietes autonomās tiesības izvēlēties abortu ir negatīvas tiesības – tās var īstenot likumā noteiktajās robežās, ja sieviete var atrast ārstu, kurš ir gatavs veikt abortu. Lai aizsargātu ārsta autonomiju, ārstu ētikas kodeksi un likums ļauj ārstam atteikties no aborta veikšanas, ja tam nav medicīnisku iemeslu. Līdz ar to, Latvijas likumos šobrīd ir iekļautas normas, kas aizsargā gan sievietes, gan ārsta autonomiju abortu jomā, atbilstoši bioētikas principiem.
Nekaitēšana un laba darīšana
Nekaitēšanas un laba darīšanas principu mērķis ir novērst iespējamos kaitējumus cilvēka veselībai, kā arī nodrošināt pēc iespējas labāku veselības aprūpi. Vēsturiskā pieredze liecina, ka abortu ierobežošana vai aizliegšana var nodarīt būtisku kaitējumu sievietes veselībai. Lielākajā daļā Rietumu valstu aborti tika legalizēti 20. gadsimta vidū, un pirms tam aborta veikšana bija fiziski un psiholoģiski traumējoša pieredze. Parasti netika lietota anestēzija, sarežģījumu gadījumā bija grūti saņemt medicīnisku palīdzību, kā arī par aborta veikšanu tika prasīta ļoti augsta samaksa. Rezultātā bija augsta sieviešu mirstība un būtisks veselībai nodarītais kaitējums. Līdzīga situācija arī mūsdienās rodas valstīs, kurās ir strikti ierobežota vai aizliegta abortu veikšana.
Abortu legalizācija ir mazinājusi fizisko kaitējumu sievietes veselībai, tomēr tā vēl arvien ir psiholoģiski traumējoša pieredze. Šī iemesla dēļ svarīga ir abortu skaita samazināšana. Tomēr nekaitēšanas principa kontekstā nozīmīgs ir arī jautājums, ar kādiem paņēmieniem tiek mazināts abortu skaits. Pamatoti un ētiski attaisnojami ir pasākumi, kas ir vērsti uz izglītošanu reproduktīvās veselības jomā, kontracepcijas līdzekļu pieejamības uzlabošanu, sociālās palīdzības sniegšanu grūtniecības laikā un pēc dzemdībām. Turpretī piespiedu pasākumi, piemēram, atsevišķos ASV štatos praktizētā obligātā ultrasonogrāfija pirms aborta veikšanas, kuras laikā sievietei obligāti ir jāskatās monitorā, rada jautājumus par valsts tiesībām iejaukties ārsta un pacienta attiecībās, kā arī par iespējamo psiholoģisko kaitējumu.
Lai gan ideālais mērķis būtu sabiedrība, kurā izglītība un sociālie pasākumi ļautu pilnībā atteikties no nepieciešamības veikt abortus, tā sasniegšana šķiet visai utopiska.
Skatoties uz reālo situāciju, jāatzīst, ka kopumā abortu ierobežošana vai aizliegšana nodara lielāku kaitējumu sieviešu fiziskajai un psiholoģiskajai veselībai nekā abortu legalizēšana. Tomēr, lai mazinātu abortu skaitu, būtiski ir neaizmirst par tādas rīcībpolitikas veidošanu, kas ir vērsta uz izglītošanu, kontracepcijas pieejamību un sociālo atbalstu.
Balansēšana uz taisnīguma un vienlīdzības asmens
Taisnīguma princips bioētikā nosaka vienlīdzīgu attieksmi un vienlīdzīgu pieeju nepieciešamajiem resursiem un pakalpojumiem veselības aprūpes jomā. Ievērojamais liberālā taisnīguma teorētiķis Dž. Roulzs uzskatīja, ka agrīnajās grūtniecības attīstības stadijās sieviešu tiesības uz vienlīdzīgu lēmumu pieņemšanu ir būtiskākas nekā embrija tiesības uz dzīvību[4]. Viņa skatījumā abortu aizliegums nostāda sievietes nevienlīdzīgā pozīcijā, salīdzinājumā ar vīriešiem, jo vīriešiem seksuālās attiecības nerada risku, ka viņiem iestāsies nevēlama grūtniecība. Tādēļ sievietēm ir jārada un, iespējams, pat jāgarantē iespēja veikt abortu. Ir netaisnīgi aizliegt sievietei izvēles iespējas, kas attiecas uz viņas ķermeni, it īpaši situācijās, kad viņai trūkst nepieciešamo iztikas līdzekļu un sociālā atbalsta sistēmas nevar tos nodrošināt.
Izvēles sekas
Pieņemot izmaiņas normatīvajos aktos, kas rada tiesisku pamatu abortu aizliegumam, Latvija tuvotos vēsturiskajam Rumānijas piemēram. 1966. gadā rumāņu diktators Nikolaje Čaušesku kriminalizēja abortus, atļaujot abortu veikšanu tikai sievietēm, kas vecākas par 45 gadiem un dzemdējušas ne mazāk kā piecus bērnus; smagu pārmantojamu slimību gadījumā; gadījumos, kad grūtniecība apdraud sievietes dzīvību; kā arī izvarošanas vai incesta gadījumā[4]. Šis aizliegums paaugstināja dzimstības rādītājus, kā bija plānojis diktators, tomēr vienlaikus dramatiski palielināja arī sieviešu mirstību. Rumānija kļuva par valsti ar augstāko maternālo mirstību Eiropā (1989. gadā tie bija 170 nāves gadījumi uz 100 000 dzīvi dzimušiem bērniem. 87 procenti sieviešu mirušas no sarežģījumiem, kas saistīti ar nelegālo abortu izraisītajiem sarežģījumiem). Vai tas ir piemērs, kam gribam tuvoties?

Čīliešu pētnieki Elarda Koha vadībā pētījumā „Women's Education level, Maternal health facilities, Abortion legislation and Maternal deaths” (publicēts www.plosone.org )norāda, ka sievieš mirstības samazināšanās cēlonis ir izglītības līmeņa un medicīnas pakalpojumu kvalitātes celšanās, nevis abortu likumība. Amerikāņu profesors M. Ņūss (M. News) rakstā „ Baning abortions doesn't hurt women's health ” ( www.lifenews.com ) norāda, ka sieviešu mirstības samazināšanās Rumānijā ir jāsaista nevis ar aborta legalizāciju 1989.gadā, bet gan ar medicīnas pakalpojumu kvalitātes paaugstināšanos.
